“THE AGREEMENT” 

The following are the terms and conditions of use (hereinafter “The Agreement”) for PoundersLaw.com, a Texas online practice of law managed by Mr. Tracy A. Pounders, a Texas licensed attorney and counselor at law.  By registering to use this website you are representing that you are at least 18 years of age, able to enter into a contract with The Pounders Law Firm, PLLC, and agree to the terms of The Agreement.

LIMITED REPRESENTATION 

The purpose of this law practice is to promptly provide limited legal advice and general counseling on matters of Texas law in a cost effective manner.  Unless expressly agreed to in writing to the contrary, The Pounders Law Firm, PLLC and its attorneys, Managers, Members, Owners, officers and employees will not provide physical legal representation or commence litigation on your behalf.  If during any communication between you and The Pounders Law Firm, PLLC we determine that your specific matter requires the legal engagement of a full-service or retail law firm, we will promptly communicate this to you and either refer you to another law firm or to an appropriate referral service.

The legal services provided by us are limited to those services you have requested and purchased and we have agreed to provide and have so provided to you.  As with all legal services we cannot guarantee any legal outcome.  After we have completed the work we will not continue to perform in an additional capacity, and it will not be our responsibility to make sure that the documents provided to you are properly filed, attend any hearings or trials on your behalf, or to provide any other legal services related to the matter.  By purchasing our services you agree that you have assumed the responsibility to timely and properly file any and all legal documents provided to you, and to comply with all federal, state and local procedures.  The Pounders Law Firm, PLLC shall not pay any court costs associated with your case, should it go to lawsuit, any filing fees or service of process fees, unless it expressly agrees to do so in writing.

This website and legal practice offers services related to Texas law only.  Our website should not be construed as a solicitation for legal services related to any state other than Texas.  The Pounders Law Firm, PLLC does not desire to represent anyone from a state where this website fails to comply with all laws and rules of ethics of that state.

CONFIDENTIALITY / ATTORNEY-CLIENT COMMUNICATIONS

The Pounders Law Firm, PLLC is bound by stringent professional standards of confidentiality.  All attorney-client privileged information provided to it will be kept in confidence, and will not be released to anyone outside of this practice unless required by law or authorized by you.  Transmission of information between you and The Pounders Law Firm, PLLC does not create an attorney-client relationship, nor a duty of confidence between you and the law firm.  Our duty of confidentiality and attorney-client privilege may not exist prior to a check for possible conflicts of interest and a confirmation of representation by The Pounders Law Firm, PLLC.  The Pounders Law Firm, PLLC reserves the right to decline the representation of any potential client for any reason.  Client files are securely retained in an electronic format, are routinely and securely backed up, and held for the period of time required by Texas law.  All information sent to The Pounders Law Firm, PLLC by internet email or through the PoundersLaw.com website is not secure and shall not be considered to be made on a confidential basis.

By registering to use this website you are representing that the information you provide us is correct, accurate and up-to-date.  The Pounders Law Firm, PLLC requests that you keep the information you provide to us current.  Please log in to your client page from time to time to review and update your contact information and other personal data.

CLIENT FUNDS 

There will be no fee charged for registering for an account from this website.  Nonetheless, some services may not be performed prior to the receipt of a retainer fee.  Client funds will not be transferred from the law firm’s IOLTA Trust Account to its Operating Account prior to the completion of the work and client access to same, unless agreed to otherwise.  All credit card payments are processed by a Cardholder Information Security Program (CISP) compliant credit card processor; no credit card or other account numbers are retained by The Pounders Law Firm, PLLC unless authorized by you, or as required by law.

SEVERABILITY

Should any provision of The Agreement be found to be unenforceable, illegal or invalid, it shall not affect the enforceability, legality or validity of any other provision of The Agreement.

IRS CIRCULAR 230 DISCLOSURE

Pursuant to requirements imposed by the Internal Revenue Service, any tax advice contained in this communication (including any attachments) is not intended to be used, and cannot be used, for purposes of avoiding penalties imposed under the United States Internal Revenue Code or promoting, marketing or recommending to another person any tax-related matter. Please contact us if you wish to have formal written advice on this matter.

VENUE AND CHOICE OF LAW 

The Agreement is governed by the laws of the State of Texas.  The federal and state courts of Dallas County, Texas shall have exclusive jurisdiction over any case or controversy arising from or relating to: (1) and condition or term of The Agreement, (2)  this website, and (3) all services provided to you by The Pounders Law Firm, PLLC.  Each person who registers on this website voluntarily waives both any defense of forum non conveniens and any right to a trial by jury.

  • We offer the use of a secure server. All supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our Payment gateway providers database only to be accessible by those authorized with special access rights to such systems, and are required to keep the information confidential.
  • After a transaction, your private information (credit cards, social security numbers, financials, etc.) will not be kept on file for more than 60 days.

DO WE USE COOKIES?

This website may use cookies to store a Session ID.  A Session ID and cookies are required so that we can provide you with a secure transaction and confidential communications.  In order to register and use this website cookies must be enabled.
